1)  General Terms and Conditions
This web-site is intended to be a friendly, enjoyable and useful experience, but as with anything concerning any kind of transactions there are risks involved and we strongly advise you to understand all of these terms before joining. If you spot a listing that you feel is violating the general terms and conditions of this web-site as stated below please let us know by contacting us.

2)  Rights To Suspend or Terminate.
You agree that this web-site, in its own discretion, may terminate any of your auctions or use of the service immediately and without notice if
(a) We believe that you are not abiding by the general rules of this web-site
(b) You have repeatedly broken a certain term
(c) You have listed a suspicious item
(d) We believe you to be a non paying bidder.

In most cases when we suspect foul play we will suspend your account/listing whilst we investigate further. If our investigation is conclusive then your account with us will be terminated.

3)  Your item descriptions.
We do not permit users to link to any site other than their SpecialistAuctions store in item descriptions in standard auctions.  In addition, we do not permit the insertion of email or other addresses or telephone numbers in item descriptions.

We do not allow the use of any external links in store or personal descriptions of any kind other than by Category Moderators.

We reserve the right to remove any listing that infringes this requirement without reference to the Seller.  In extreme cases we will deactivate the Sellers account with SpecialistAuctions.

4)  Your Conduct.
You are solely responsible for the contents of your actions through this web-site. You must ensure that your participation in the selling or buying of items does not violate any applicable laws or regulations. By this we mean that you must check that you entitled to sell or buy the relevant item and that you are not prohibited from doing so by any law or regulation.
You must not transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material. You must also not transmit any material that encourages conduct that could constitute a criminal offence, give rise to civil liability or otherwise violate any applicable law or regulation.

5)  Membership.
Membership to this web-site is only available to those who can form a legally binding contract. This web-site does not permit minors (under
18) to register. If any member fails to declare their correct age the account will be terminated immediately.

6)  General Terms.
This site acts as the window for sellers to conduct auctions and for bidders to bid on sellers' auctions. We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items listed, the truth or accuracy of the listings, the ability of sellers to sell items or the ability of buyers to buy items. We cannot and do not control whether or not sellers will complete the sale of items they offer or buyers will complete the purchases of items they have bid on.
In addition, note that there are risks of dealing with foreign nationals, underage persons or people acting under false pretence.
This Web-site shall not be responsible for any items sold by Auction, for any damage to items during transit or during the inspection period, nor for misrepresentations and/or breaches of contract by either buyer and/or seller. This web-site shall not be responsible for the cost of procurement of substitute goods or any losses resulting from any goods purchased or obtained.
This web-site assumes no liability for the content of the listings.
However if you fall victim of a fraudulent transaction we will assist you as much as we can.

This website actively discourages trading in fake items and will remove any item that is a fake that it becomes aware of. However, you should be aware that Caveat Emptor applies and should satisfy yourself with regard to the validity of items you bid on or win.

Items offered include VAT where applicable.  Delivery costs are clearly stated by the Seller in the description of each item offered

7)  Moderators and Forums.

The onus and any risk lie with the purchaser to satisfy themselves with regard to the accuracy, provenance, value, suitability, safety or legality of an item or items commented on by a Moderator or another Member in the listings or associated Forums of this web-site.

8) Non Payment of fees

Any fees that remain unpaid 21days after the 1st of the month in which the invoice is raised, will result in the users account being suspended until payment is made. Any costs incurred by Specialist Auctions in recovering the debt, including but not limited to solictors fees, debt recovery fees, costs of letters, e-mails, telephone calls will be chargable. We reserve the right to pass on all non paying users details to credit reference agencies.

9) Disclosure of member information

We may disclose personal information to respond to legal requirements, enforce our policies, respond to claims that a listing or other content infringes the rights of others, or protect anyone's rights, property, or safety. We may also share your personal information with Service providers under contract who help with our business operations (such as fraud investigations, bill collection, affiliate and rewards programs and customer support). Law enforcement agencies, other governmental agencies or third parties in response to a request for information (such as a Section 29 (3) Data Protection Act 1998 form) relating to a criminal investigation, alleged illegal activity or any other activity that may expose us, you or any other Specialist Auction user to legal liability. The personal information we disclose may include your User ID and User ID history, name, city, county, telephone number, email address, fraud complaints and bidding and listing history or anything else that we deem relevant. Specialist Auctions Programme participants in connection with an investigation of fraud, intellectual property infringement, piracy, or other unlawful activity, as we in our sole discretion believe necessary or appropriate, either under confidentiality agreement or as required by law. In such circumstances, we may disclose name, street address, city, county, postcode, country, phone number, email address and company name. Without limiting the above, in an effort to respect your privacy and our ability to keep the community free from those who attempt to carry out fraudulent or illegal activities on the site, we will not otherwise disclose your personal information to law enforcement, other government officials, or other third parties without a court order or substantially similar legal procedure, except when we believe in good faith that the disclosure of information is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity.

11)  Laws.
These Terms of Service shall be governed by and constructed in accordance with the laws of England and Wales and any disputes will be decided only by the Courts of England and Wales.
